論資源物權(quán)的社會性義務(wù)
摘 要
資源物權(quán)是指以自然資源為客體的物權(quán)，即權(quán)利人為滿足其權(quán)益需要，對自然資源依法或依合同所享有的直接支配與排除妨礙的權(quán)利。資源物權(quán)的社會性義務(wù)是指基于社會公共利益而產(chǎn)生的負(fù)載于資源物權(quán)上的義務(wù)。資源物權(quán)的社會性義務(wù)的類型主要包括資源的有限支配義務(wù)、資源的生態(tài)保護(hù)義務(wù)�，F(xiàn)行資源物權(quán)立法上的缺陷主要表現(xiàn)為：自然資源所有權(quán)虛置、自然資源流轉(zhuǎn)制度不健全、自然資源使用權(quán)物權(quán)化程度不高等。我國資源物權(quán)的立法完善要求：在物權(quán)法體系下進(jìn)行資源物權(quán)立法、突出對資源所有權(quán)的保護(hù)與限制、由特別法來規(guī)定有利于環(huán)境和資源的保護(hù)等，以強(qiáng)調(diào)資源物權(quán)的社會性義務(wù)，實(shí)現(xiàn)資源的可持續(xù)利用。

Abstract
Property Resources refers to the natural resources of the object of property rights and human rights that meet their interests, on natural resources or contract enjoyed by the direct control and to remove the right. Property resources of social obligation is based on social and public interests in the resource load on the property obligations. Property resources of social obligations to the main types including limited resources disclaimer obligations, resources and the ecological protection obligations. Current Legislation on the performance of the major defects : a sham ownership of natural resources, natural resources circulation system is not perfect and the right to use natural resources real degree of higher. Property of the countrys resources Legislation requirements : in the real law system resources Legislation, Highlighting resources and the protection of ownership restrictions by the special law to help provide the environment and resources protection. real resources to emphasize social obligations to achieve the sustainable use of resources.
