論刑事訴訟中的證明責(zé)任和舉證責(zé)任

摘    要

    證明責(zé)任是刑事訴訟證明理論的核心部分，但長期以來，學(xué)界往往將證明責(zé)任和舉證責(zé)任混為1談。通過對(duì)證明責(zé)任和舉證責(zé)任這兩個(gè)概念進(jìn)行辨析，分析證明責(zé)任和舉證責(zé)任各自的分配原則及責(zé)任承擔(dān)主體，有利于完善和豐富刑事訴訟證明理論。

ABSTRACT
  
Proved the responsibility is the core that proved the theory of the criminal prosecution. But since long ago, academic circles think proves the responsibility and presents evidence the responsibility are the same concept. Compared with proved the responsibility and presents evidence the responsibility these two concepts, the analysis proved the responsibility and presents evidence the responsibility respective assignment principle and the responsibility undertakes the main body. This is advantageous to being perfect and the rich criminal prosecution proves the theory.
